Se remitió el expediente de la referencia al Juzgado Primero Penal del Circuito de Quibdó, para que ejerciendo sus competencias constitucionales y legales, decida la tutela del ciudadano de la referencia contra el ISS Seccional Chocó y la Universidad Tecnológica del Chocó.
La Corte explicó que el Juez de tutela al que le corresponda por reparto un proceso y considere que es necesario vincular a otra persona al mismo, puede hacerlo sin que ello implique efectuar un mero reparto o plantear, como en este caso, un conflicto negativo de competencia.
